These Terms and Conditions govern access to and use of Clientky's services, including its digital platform, website clientky.app, applications and all related services (the "Services"). For inquiries, please contact us at support@clientky.app.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SERVICES. BY ACCESSING OR USING THE PLATFORM, YOU AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.

1. Service Description

Clientky is a multichannel inbox platform for teams that sell or support customers via chat. Through our Services, you can:

  • Manage WhatsApp Business conversations using Meta's official API
  • Connect and manage messages from Instagram and Facebook Messenger
  • Manage contacts, lifecycle, and team conversations
  • Organize team work from a shared inbox
  • Access operational metrics and reports for your account

2. Account Registration

2.1. To use the Services, you must create a Clientky account. You are responsible for maintaining the confidentiality of your access credentials and all activity that occurs under your account.

2.2. When registering, you represent that the information provided is truthful, accurate, and current. If you are acting on behalf of an organization, you represent that you have the authority to bind that organization.

2.3. Use of the Services is prohibited for minors as defined by applicable law.

2.4. Clientky reserves the right to suspend or cancel any account that violates these terms, without prior notice and without giving rise to any claim.

3. Acceptable Use

When using the Services, you agree to:

  • Use the Services only for lawful purposes related to your business
  • Not send unsolicited messages (spam) or illegal, abusive, or offensive content
  • Comply with the policies of integrated platforms (Meta, WhatsApp, Google)
  • Not attempt to access unauthorized systems or data
  • Not interfere with the normal operation of the Platform
  • Not use the Services to impersonate identities or deceive third parties
  • Comply with all applicable laws, including personal data protection regulations

4. Third-Party Integrations

4.1. The Services include integrations with third-party platforms such as Meta (WhatsApp Business, Facebook, Instagram), Google, and payment providers. Use of these integrations is subject to the terms and policies of each provider.

4.2. Clientky acts as a technical intermediary and is not responsible for changes, interruptions, or policies of third-party platforms.

4.3. By connecting your social media accounts or external services, you authorize Clientky to access and manage the information necessary to provide the Services.

5. Plans and Payments

5.1. The Services are offered through monthly or annual subscription plans, with the features and prices published on the Platform.

5.2. Subscriptions renew automatically at the end of each period unless you cancel before the renewal date.

5.3. Payments made are non-refundable, except where expressly required by applicable law.

5.4. Clientky reserves the right to modify prices, notifying at least 15 days in advance by email.

5.5. Template costs, conversation charges, or fees applied by Meta or other integrated providers are disclosed separately and billed according to each third party's current policies. Clientky does not sell additional message packages at this stage of the product.

6. Intellectual Property

6.1. All rights to the Platform, including software, design, trademarks, logos, and content, are the exclusive property of Clientky or its licensors.

6.2. You are granted a limited, non-exclusive, non-transferable license to use the Services in accordance with these terms. This license does not imply any transfer of ownership.

6.3. Content you upload or generate through the Platform remains your property. You grant Clientky a license to use that content solely for the purpose of providing the Services.

7. Privacy and Data

The processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By using the Services, you accept that policy.

8. Limitation of Liability

8.1. The Services are provided "as is" and "as available". Clientky does not guarantee that the Services will be uninterrupted, secure, or error-free.

8.2. Clientky will not be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use the Services.

8.3. Clientky's total liability shall not in any case exceed the amount you have paid for the Services in the previous 12 months.

8.4. Clientky is not responsible for the content of messages you send or receive through the Platform, nor for the actions of third parties.

9. Indemnification

You agree to indemnify and hold harmless Clientky, its directors, employees, and agents from any claim, damage, or expense (including legal fees) arising from: (a) your use of the Services, (b) your breach of these Terms, (c) your violation of third-party rights, or (d) the content you transmit through the Platform.

10. Modifications

Clientky may modify these Terms at any time. Material changes will be communicated by email or through a notice on the Platform. Continued use of the Services after changes implies acceptance of the modified terms.

11. Termination

11.1. You may cancel your account at any time from the Platform settings or by contacting support.

11.2. Clientky may suspend or terminate your access for breach of these Terms, prolonged inactivity, or any reasonable cause.

11.3. Upon termination, your right to use the Services will cease immediately. Data may be deleted in accordance with our Privacy Policy.

12. Governing Law

These Terms are governed by the laws of the Argentine Republic. Any dispute will be submitted to the ordinary courts of the Autonomous City of Buenos Aires, with both parties waiving any other jurisdiction that may apply.
